{"id":2788,"date":"2022-03-16T12:00:53","date_gmt":"2022-03-16T10:00:53","guid":{"rendered":"http:\/\/www.lac.org.na\/?p=2788"},"modified":"2022-03-16T12:20:19","modified_gmt":"2022-03-16T10:20:19","slug":"kashela-case-presentation","status":"publish","type":"post","link":"https:\/\/www.lac.org.na\/index.php\/2022\/03\/16\/kashela-case-presentation\/","title":{"rendered":"Kashela Case Presentation"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-2789 \" src=\"http:\/\/www.lac.org.na\/wp-content\/uploads\/2022\/03\/IMG_1412-1024x683.jpg\" alt=\"\" width=\"459\" height=\"306\" \/>Following the October 2021 Stakeholder engagement breakfast meeting, the Land, Environment and Sustainable Development Department (LEAD) presented the <strong><a href=\"http:\/\/www.lac.org.na\/news\/cases\/Kashela_v_Katima_Mulilo_Town_Council_7_Others-2018.pdf\">same case<\/a> <\/strong>to the Parliamentary <a href=\"https:\/\/www.parliament.na\/standing-committee-on-natural-resources\/\">Standing Committee on Natural Resources<\/a> after being invited by <strong><a href=\"https:\/\/www.parliament.na\/dt_team\/tweya-tjekero-2\/\">Hon Tweya<\/a> <\/strong>who could not attend the first meeting, to share the same discussion with the whole committee as well as the outcome of the <a href=\"http:\/\/www.lac.org.na\/index.php\/2021\/10\/27\/communal-land-and-local-authorities\/\">October meeting<\/a>.<\/p>\n<p>In essence the 2018 ruling is significant because it confirms that customary law land rights are not automatically extinguished\u00a0 where <a href=\"http:\/\/www.lac.org.na\/laws\/annoSTAT\/Communal%20Land%20Reform%20Act%205%20of%202002.pdf\">communal land<\/a> is transferred into a local authority area. The implication of this ruling is that customary land rights granted before independence are also protected by law and the local authority is obliged to respect them.
