{"id":411,"date":"2020-02-20T14:27:09","date_gmt":"2020-02-20T14:27:09","guid":{"rendered":"http:\/\/wp.lac.org.na\/wordpress\/?page_id=411"},"modified":"2021-11-24T22:12:10","modified_gmt":"2021-11-24T20:12:10","slug":"labour-issues","status":"publish","type":"page","link":"https:\/\/www.lac.org.na\/index.php\/projects\/gender-research-advocacy-grap\/labour-issues\/","title":{"rendered":"Labour issues"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column width=&#8221;3\/4&#8243;][vc_column_text]<\/p>\n<h2>Encouraging equal opportunities in the workplace<\/h2>\n<p>This <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/equalopppamp.pdf\"><strong>booklet<\/strong><\/a> summarizes provisions from the <a href=\"http:\/\/www.lac.org.na\/laws\/annoSTAT\/Labour%20Act%2011%20of%202007.pdf\">Labour Act 9 of 2007<\/a>, the <a href=\"http:\/\/www.lac.org.na\/laws\/annoSTAT\/Foreign%20Investments%20Act%2027%20of%201990.pdf\">Foreign Investments Act 27 of 1990<\/a>, the <a href=\"http:\/\/www.lac.org.na\/laws\/annoSTAT\/Co-operatives%20Act%2023%20of%201996.pdf\">Co-operatives Act 23 of 1996<\/a>, and the <a href=\"https:\/\/www.lac.org.na\/laws\/annoNAM\/LABOUR%20(1998)%20-%20Affirmative%20Action%20(Employment)%20Act%2029%20of%201998%20(annotated).pdf\">Affirmative Action (Employment) Act 29 of 1998<\/a>.<\/p>\n<p>The pamphlet provides ideas on how an employer can put the provisions into meaningful practice and gives suggestions on how to go beyond the basic provisions to encourage real and practical change that will encourage equal opportunities in the workplace.<\/p>\n<p>The pamphlet is intended for employers and employees alike and it is hoped that the information, now provided in a simple and accessible form, is utilized by many workplaces to encourage positive change in the employment environment in Namibia.<\/p>\n<p>[\/vc_column_text][\/vc_column][vc_column width=&#8221;1\/4&#8243;][vc_single_image image=&#8221;725&#8243; img_size=&#8221;medium&#8221;][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<\/p>\n<h2><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-726 size-medium\" src=\"http:\/\/www.lac.org.na\/wp-content\/uploads\/2020\/05\/grap_labour-2-209x300.jpg\" alt=\"\" width=\"209\" height=\"300\" \/>Gender and the Labour Act<\/h2>\n<p>The Labour Act 15 of 2004 (passed but never brought completely into force) was completely replaced by the new <a href=\"http:\/\/www.lac.org.na\/laws\/annoSTAT\/Labour%20Act%2011%20of%202007.pdf\"><strong>Labour Act 11 of 2007<\/strong><\/a>. GR&amp;AP advocacy helped to ensure that the new law included provisions on sexual harassment, pregnancy discrimination, maternity leave and family leave. We made submissions on these and other human rights issues to the Ministry of Labour, the National Union of Namibian Workers, the Namibian Employers Federation, and the International Labour Organisation, and most of our concerns were addressed in the bill before it became final.<\/p>\n<p>GR&amp;AP also made submissions to the Ministry of Labour on the draft Code of Practice on Sexual Harassment.<\/p>\n<p>GR&amp;AP has produced a simple 8-page information booklet about the provisions relating to gender in the 2007 Labour Act. This booklet is available in\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/gender_labour_act_eng.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>English<\/strong><\/a>,\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/gender_labour_act_osh.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Oshiwambo<\/strong><\/a>\u00a0and <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/gender_labour_act_afr.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Afrikaans<\/strong><\/a>.<\/p>\n<p>GR&amp;AP has also prepared a short training module about\u00a0<strong><a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/gender_labour_act_eng.pdf\">Gender and the Labour Act<\/a>,\u00a0<\/strong>and a comic on sexual harassment in <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/comicworkplaceharassmentforweb.pdf\"><strong>English<\/strong><\/a><strong>, <\/strong><a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/gender_labour_act_osh.pdf\"><strong>Oshiwambo<\/strong><\/a> and <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/comicworkplaceharassmentafrikaans.pdf\"><strong>Afrikaans<\/strong><\/a><strong>. \u00a0<\/strong><\/p>\n<p>GR&amp;AP worked other LAC departments to litigate a test case on sexual harassment involving a young woman who was allegedly harassed at the workplace by her immediate supervisor. The matter was settled in terms favourable to our client before the case\u2019s conclusion, and the settlement order stipulated that GR&amp;AP would be allowed to publish an article about the case, without identifying the parties involved. You can read our article about the sexual harassment case <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/sexualharassmentNamibianarticle2008.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>here<\/strong><\/a>.<\/p>\n<h2><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-2616 alignright\" src=\"http:\/\/www.lac.org.na\/wp-content\/uploads\/2021\/11\/PUBLIC-6-Gender_and_Labour_Act-2021-300x166.jpg\" alt=\"\" width=\"385\" height=\"213\" \/>Powerpoint presentations<\/h2>\n<p>These presentation provide information on the following issues:<\/p>\n<ul>\n<li><b>discrimination<\/b> on the basis of sex, family responsibilities or pregnancy<\/li>\n<li><b>pregnancy<\/b><\/li>\n<li><b>maternity leave<\/b><\/li>\n<li><b>family responsibilities<\/b><\/li>\n<li><b>compassionate leave<\/b><\/li>\n<li><b>sexual harassment<\/b><\/li>\n<li><b>special rules for domestic workers<br \/>\n<\/b><\/li>\n<\/ul>\n<p>and is available for the <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/PUBLIC-6-Gender_and_Labour_Act-2021.pptx\">general public<\/a> and <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/SP-6-Gender_and_Labour_Act-2021.pptx\">community leaders or service providers<\/a><\/p>\n<h2>Child labour and child exploitation<img loading=\"lazy\" decoding=\"async\" class=\"alignright wp-image-729 size-medium\" src=\"http:\/\/www.lac.org.na\/wp-content\/uploads\/2020\/05\/grap-labour-3-212x300.jpg\" alt=\"\" width=\"212\" height=\"300\" \/><\/h2>\n<p>The Discussion Document on Child Labour in Namibia published by the Ministry of Labour and Child Welfare in March 2007 cites LAC research and recommendations extensively, particularly on sex work, domestic work, trafficking and child justice. This is because the World Health Organisation recommends that mothers exclusively breastfeed their children for six months. However breastfeeding in Namibia is low &#8211; the percentage of mothers who exclusively breastfeed their children for 0-2 months is 53.6%, dropping to 22.9% for children aged 2-3 months and further dropping to 5.7% for children aged 4.5 months.<\/p>\n<p>One contributing factor is the lack of public awareness about the advantages of exclusive breastfeeding for six months. Another contributing factor is that maternity leave is only three months, with one month normally taken before the birth of the child. The maternity leave provision is a push factor for many mothers to wean their children early. Furthermore, the recently released government National Agenda for Children states that one of the government\u2019s priority strategies is to promote exclusive breastfeeding for the first six months of life; however the report does not make it clear how the government intends to balance this commitment with the Labour Act and Social Security Commission\u2019s current provision of three rather than six months maternity leave.<br \/>\nFor more information, see the GR&amp;AP factsheet <strong><a href=\"..\/projects\/grap\/Pdf\/Maternityleave10reasons.pdf\">&#8220;10 reasons to extend maternity leave to 6 months after birth&#8221;<\/a><\/strong>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column width=&#8221;1\/4&#8243;][vc_single_image image=&#8221;865&#8243; img_size=&#8221;medium&#8221;][\/vc_column][vc_column width=&#8221;3\/4&#8243;][vc_column_text]<\/p>\n<h2>Rights of domestic workers<\/h2>\n<p>In 2010 GR&amp;AP placed a particular focus on the rights of domestic workers. In the pre-independence labour law domestic workers were completely excluded from the basic working conditions in pre-Independence labour law. Whilst much progress has been made since then, the challenge remains that the rights of domestic workers are often overlooked.[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]The Labour Resource and Research Institute (LaRRI) published a study on domestic workers in in 2008 &#8211; the first of its kind since 1996, when the Legal Assistance Centre and the Social Science Division of the University of Namibia published an initial report on the sector (read the\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/livingandworking.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>summary<\/strong><\/a>). According to the LaRRI report, the majority of domestic workers are single women between the ages of 21 and 40 who support, on average, 2 to 6 dependants. Most of them work long hours without breaks or meals. Social security benefits, medical aid and pensions are largely non-existent in the industry. For the 20% who live in the houses of their employers, the likelihood of unpaid overtime, lack of benefits, low wages and abuse is even higher on average than for non-live-in workers. Domestic workers are clearly some of the most neglected and vulnerable women in the country.GR&amp;AP has produced a\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/domworkersfactsheet.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>factsheet<\/strong><\/a><strong>\u00a0<\/strong>about the rights of domestic workers to ensure that both employers and domestic workers understand their rights. These include, for example, the need to register a domestic worker with the Social Security Commission, a requirement that many people seem to be unaware of.<\/p>\n<p>We have also produced a <strong>comic<\/strong> (<strong><a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/comicsocialsecuritybenefits_eng.pdf\">English<\/a>, <a href=\"..\/projects\/grap\/Pdf\/comicsocialsecuritybenefits_afri.pdf\">Afrikaans<\/a><\/strong> and <strong><a href=\"..\/projects\/grap\/Pdf\/comicsocialsecuritybenefits_osh.pdf\">Oshiwambo<\/a><\/strong>) on how to claim social security benefits for maternity leave, with the main character in the story being a domestic worker.<\/p>\n<p>A set of <a href=\"http:\/\/www.lac.org.na\/laws\/annotated_regulations.html#L\"><strong>regulations<\/strong><\/a> has been issued under the Labour Act relating to domestic workers. They require employers of domestic workers to submit a form annually to the Permanent Secretary of the labour ministry or to the Labour Office containing certain particulars about domestic workers.<\/p>\n<p>In 2017, these regulations were supplemented by a <a href=\"http:\/\/www.lac.org.na\/laws\/2017\/6428.pdf\"><strong>Wage Order<\/strong><\/a> setting a minimum wage for domestic workers for the first time, and providing for supplementary minimum conditions of employment for domestic workers.\u00a0 This Wage Order also contains rules about transport allowances, accompanying employers on holiday, food and accommodation, health and safety, uniforms, trade union access and a written contract of employment on a standardised form.<br \/>\nIn 2018, another notice <a href=\"http:\/\/www.lac.org.na\/laws\/2018\/6767.pdf\"><strong>increased the minimum wage<\/strong><\/a>.\u00a0 With effect from 1 October 2018, the minimum wage is N$1564.39\/month, N$361.29\/week, N$72.25\/day or N$9.03\/hour, and N$45.15\/day for part-time domestic workers who work five hours or less on any day other than a Sunday or public holiday.\u00a0 The Wage Order\u2019s rates for minimum overtime pay and minimum pay for work on Sundays and public holidays were similarly increased.<\/p>\n<p>Read articles from our archives about the rights of domestic workers and the need for a minimum wage in the sector:<\/p>\n<ul>\n<li><a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/domworkersCindyopedone.pdf\"><strong>It\u2019s time to give Namibia\u2019s domestic workers their due<\/strong><\/a> (2010)<\/li>\n<li><a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/domworkersCindyopedtwo.pdf\"><strong>Why Are The Rights Of Domestic Workers So Often Ignored?<\/strong><\/a> (2010)<\/li>\n<\/ul>\n<p>[\/vc_column_text][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column width=&#8221;3\/4&#8243;][vc_column_text] Encouraging equal opportunities in the workplace This booklet summarizes provisions from the Labour Act 9 of 2007, the Foreign Investments Act 27 of 1990, the Co-operatives Act 23 of 1996, and the Affirmative Action (Employment) Act 29 of 1998.
