The surroundings are usually formal and unfamiliar, cross-examination (meaning the questions asked by the lawyer who is defending the accused) can be unnecessarily aggressive and the witness may lack a thorough understanding of the courtroom procedure. The witness may also be afraid to testify in the presence of the accused in a criminal case, or in the presence of a hostile party in a civil case. These problems can be particularly acute for children, people with disabilities, and victims of sexual offences or domestic violence.\r\n\r\n[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column width=&#8221;1\/2&#8243;][vc_column_text]In 1998, at the request of Namibia\u2019s Law Reform and Development Commission, the Legal Assistance Centre prepared a <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/children_in_court_vulnerable_witnesses_report.pdf\"><strong>paper<\/strong><\/a> which proposed law reforms on vulnerable witnesses. The <a href=\"http:\/\/www.lac.org.na\/laws\/2003\/3123.pdf\">Criminal Procedure Amendment Act 24 of 2003<\/a> was passed to enact some of these recommendations. The category of \u201cvulnerable witnesses\u201d includes children and victims of sexual offences or domestic violence. The Act provides the following protections for vulnerable witnesses:\r\n<strong>\uf071 alternative venues for trials<\/strong>, so that they can held in environments which are less intimidating than courtrooms;\r\n\uf071<strong> testifying behind one-way screens <\/strong>or by means of closed-circuit television;\r\n\uf071 <strong>support persons to accompany witnesses while they are testifying, <\/strong>so that (for example) a young child could speak to the court while sitting on the lap of a family member\r\n\uf071 <strong>strict limitations on the use of irrelevant cross-examination to badger witnesses, <\/strong>to make it harder to intimidate or unnerve a witness\r\n\uf071 <strong>cross-examination through the presiding officer or an intermediary<\/strong>, to make sure that lawyers do not try to intimidate or confuse a witness\r\n\uf071 <strong>more possibilities for using information given by a young children prior to the trial<\/strong>, such as statements made to social workers or police officers, to avoid the necessity of asking the child to repeatedly recount the details of a traumatic experience.\r\n\r\nThis <a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/vulnerable_witnesses_summary.pdf\"><strong>document<\/strong><\/a> and this <strong><a href=\"http:\/\/www.lac.org.na\/projects\/grap\/Pdf\/childcourt2004.pdf\">article<\/a> <\/strong>provides a bit more detail about the various protections.[\/vc_column_text][\/vc_column][vc_column width=&#8221;1\/2&#8243;][vc_single_image image=&#8221;818&#8243; img_size=&#8221;large&#8221; alignment=&#8221;center&#8221;][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]These provisions have been extended by the <strong><a href=\"http:\/\/www.lac.org.na\/laws\/annoSTAT\/Child%20Care%20%20Protection%20Act%203%20of%202015.pdf\">Child Care and Protection Act 3 of 2015<\/a> <\/strong>to all proceedings in children\u2019s courts.\r\n\r\nPractical arrangements to make trials more comfortable for vulnerable witnesses are in place in courtrooms in various parts of the country.
