In 2002 the Project published a report titled &#8220;<a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/oneday.pdf\">One day we will all be equal<\/a>&#8221; \u2013 the outcome of a two year socio-legal research study into Namibia&#8217;s land reform and resettlement process.<\/p>\n<\/blockquote>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_column_text]<\/p>\n<ul>\n<li><strong>Training to Communal Land Boards<\/strong><\/li>\n<\/ul>\n<p>LEAD helped implement courses for Communal Land Boards to \u201cimplement sustainable development and environmentally sound decision-making principles\u201d when allocating communal land rights. LEAD has also been involved in a training course to provide Communal Land Boards with improved conflict management skills.<\/p>\n<p class=\"style22\">Together with other stakeholders all of Namibia\u00b4s 12 communal land boards received regular training.<\/p>\n<p class=\"style22\">Learn more about the <a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/commlandedition2_eng.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Communal Land Reform Act in this Guide<\/a>\u00a0and <a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/clbTM12.pdf\">Training manual<\/a>.<br \/>\nThe Guide to Communal Land Reform Act is in its first edition available in\u00a0 <a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/commland_afri.pdf\" target=\"new\" rel=\"noopener\">Afrikaans<\/a>,\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/commland_otji.pdf\" target=\"new\" rel=\"noopener\">Otjiherero<\/a>,\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/commland_khoe.pdf\" target=\"new\" rel=\"noopener\">Khoekhoegowab<\/a>,\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/commland_ruk.pdf\" target=\"new\" rel=\"noopener\">Rukwangali<\/a>,\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/commland_silozi.pdf\" target=\"new\" rel=\"noopener\">Silozi<\/a>,\u00a0<a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/commland_osh.pdf\" target=\"new\" rel=\"noopener\">Oshiwambo<\/a><\/p>\n<ul>\n<li style=\"text-align: left;\"><strong>Research into the Land Reform &amp; Redistribution Process<\/strong><\/li>\n<\/ul>\n<p>The Namibia Government has greatly valued LEAD&#8217;s expertise in the land reform programme, and the impact of LEAD studies on land reform has been extensive.\u00a0<span class=\"style22\">With years of close observation of the land reform process, LEAD has authored several reports on land reform, land redistribution and land expropriation.<\/span><\/p>\n<p class=\"style22\">The following LAC produced publications are based on land reform in Namibia:<\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/Seditious_State.pdf\">The Seditious State:<\/a> How to shake the poor from the communal-land safety net (2021) Peter Watson<\/li>\n<li><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/Institutional_Voids_of_Namibias_Communal_Land_Reform_Act.pdf\">Institutionalisation and institutional voids<\/a> of Namibia&#8217;s Communal Land Reform Act (2021) Paul Hebinck<\/li>\n<li>The <a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/Constitutional_&amp;_International_Law_in_Ancestral_Land_Claims.pdf\">role of Constitutional and International law<\/a> in the development of ancestral land rights claims In Namibia (2021) Willem Odendaal<\/li>\n<li><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/Land_Governance_on_Communal_Land.pdf\">Land governance on Communal land in Namibia<\/a> (2021) Wolfgang Werner<\/li>\n<li class=\"style22\"><a href=\"http:\/\/www.lac.org.na\/index.php\/projects\/land-environment-development-lead\/neither\/\" target=\"_blank\" rel=\"noopener noreferrer\">Neither here nor there:<\/a>&#8220;: Indigeneity, marginalisation and land rights in post-independence Namibia (2020)<br \/>\nThis publication summarises the legal reforms on land and links to the history of land settlement in Namibia.<\/li>\n<li class=\"style22\">&#8220;<a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/oneday.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">One Day We Will be Equal<\/a>&#8220;: A Socio-Legal Perspective on the Namibian Land Reform and Resettlement Process (2002)<br \/>\nThis publication summarises the legal reforms on land and links to the history of land settlement in Namibia.<\/li>\n<li class=\"style22\"><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/landwefarm.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">&#8220;Our Land We Farm&#8221;: An Analysis of the Namibian Commercial Land Reform Process<\/a>\u00a0(2005)<br \/>\nOne of the first evaluations of the land reform proess im commercial agricultural areas. Includes a summary of legal reforms, data on the consequences and recommendations.<\/li>\n<li><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/aplacewewanttocallourown.pdf\">A place we want to call our own<\/a>: a study on land tenure policy and securing housing rights in Namibia (2005)<\/li>\n<li class=\"style22\"><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/exprorep.pdf\">No Resettlement Available&#8230;<\/a>(2007)<br \/>\nAn in-depth investigation of the first three commercial farm expropriations in Namibia. The publication offers an analysis of the legal process, what&#8217;s been accomplished and makes recommendations.<\/li>\n<li><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/clbTM12.pdf\">Manual for Communal Land Boards<\/a>: Powers and procedures for handling land issues (2007)<\/li>\n<li class=\"style22\"><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/Kessl.pdf\">Kessl &#8211; A New Jurisprudence for Land Reform in Namibia<\/a>\u00a0(2008)<br \/>\nThis publications looks at the first legal test of land expropriation in Namibia. The case, which addresses many aspects of the Ministry of Lands and Resettlement programme on land reform, upheld the principle of land expropriation but found the Ministry&#8217;s administration of the process violated Namibian law on several grounds.<\/li>\n<li class=\"style22\"><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/womencommlandra.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Protection for Women in Namibia&#8217;s Communal Land Reform Act: Is it Working\u00a0<\/a>(2008)<br \/>\nThis research report investigates land rights for women in the four north-central regions of the country. The right of women to own land, and more specifically to inherit land in their own right is an increasingly topic issue as the HIV\/AIDS pandemic continues to take its toll. Arguably, for the Namibian public and government, the single most important aspect of women&#8217;s rights to land, or the lack thereof, has been the eviction of widows from the land they have cultivated.<br \/>\n<a href=\"http:\/\/www.lac.org.na\/news\/pressreleases\/pressr-womenslandrights.html\">Read a Press Release about this Publication<\/a><\/li>\n<li><a href=\"http:\/\/www.lac.org.na\/projects\/lead\/Pdf\/grazing_rights.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Grazing rights in Namibia\u2019s communal areas: A case study of a local land grabbing dispute in Western Kavango region<\/a>\u00a0(2014)<br \/>\nA case study from Northern Namibia looks at the Owambo herders, faced by difficulties with grazing rights, fencing off of land and an eviction order. The study looks at the impact of the eviction order on the different groups involved, and to what extent it has been resolved.
